Kim Fuller

Last week Fuller sent out another email filled with deliberate lies. I have already replied to some of his allegations so I'll only address the new ones.

1. I was in favor of the recall. It would have never cost $35,000 if the Board had followed our bylaws .

2. The Board has never announced the allegations are false.  Some Board members have given their personal opinions. None of the Board members except for Kathy Lindstrom were present on the day Scott Pessin followed a resident down the aisle.

3. I did not make false statements and I have disputed this allegation repeatedly. Fuller doesn't like my answer. And remember Fuller was the one who illegally received the security reports and published them subjecting our association to potential liability.

4.  As I've stated there was no estimate of costs because the Board shut down the project before facilities could investigate the cost. Scott Pessin on the other hand, opened a substandard cafe during the daytime without any plan or estimate of costs.  That cafe is currently doing little business because the plan wasn't run by any knowledgeable residents or committees.

5. Too lengthy to go into but false.

6.  I wasn't part of the Town Hall presentation and neither was the Food & Beverage Committee.

7. Again, the Montecito Cafe Ad Hoc Committee was not allowed to complete the necessary work.  It was Scott Pessin who opened the cafe without any plan or costs. He also didn't get input from the community.

8. I agree that only information required by our governing documents should be given to the residents.  The Board continues to be in violation of our Bylaws.

After the Board meeting in July, Scott Pessin followed a resident, Big John, down the aisle of the board meeting with his phone raised above his head and yelling at John. I heard Scott yelling which attracted my attention.  I could clearly see them from the doorway of the ballroom. At the end of the hallway, Big John appeared to trip or fall back. I heard Scott say "you pushed me".  I never saw any contact between Scott or John. Once the incident occurred, Scott left at Jerry Conrad's urging and John called security.  Once security arrived, myself and 3 others gave separate statements to security. All statements were taken by security individually.  It was less than 10 minutes before security started taking statements. When the incident occurred there were at least a dozen people still present but all the others left before security arrived. 

Kim Fuller has stated that all the witnesses lied. He bases this on the statements given to security and the mysterious video taken by Scott Pessin. He was not present.

First, security statements are confidential and private information. DRM told security they could release the statements to 3 Board members of which Scott Pessin was one.  Somehow these confidential reports made their way to Kim Fuller.  The Board claims they did an investigation and couldn't determine how Fuller got the reports.  But since Fuller reviewed the reports and Scott Pessin's private video (he refuses to allow the community to view it) you can draw your own conclusions. Fuller then calls the witnesses "a politically corrupt group" and says everyone except Scott is lying. 

NOT A SINGLE WITNESS HAS COME FORWARD BACKING UP SCOTT'S VERSION OF EVENTS (Except recently his wife). If what we said were lies why hasn't he produced contrary witnesses.  They must be visible on his video.

Kim and Scott have also concluded that since the witness statements aren't all the same it proves we're lying. Any attorney or police officer will tell you that you only worry if all the witness statements are the same. What all witnesses agree on is that Scott pursued John down the aisle. Scott agrees he pursued John down the aisle. This conduct is unbecoming of a Board member and potentially subjects the entire association to a lawsuit. Releasing the confidentially reports also potentially subjected the entire association to a lawsuit. We can't afford to take those risks again.

And where's the video?

Ask the Board how many thousands of dollars they spent conferring with attorneys after the confidential reports were given to Fuller.  Ask the Board how many thousands of dollars were spent conferring with attorneys and insurance when Scott chased a resident down the aisle after a Board meeting. Ask the Board if Scott voted on any issues related to the recall. 

For the rest of this campaign cycle you will continue to receive emails from Kim Fuller if you don't opt out.  He will continue to bash both Kathy Lindstrom and me.  We're the only candidates he will go after. He's choosing the Board members he believes he can influence now that Jerry Conrad has disappointed him. Remember what Jerry said when he chose not to run? He was told not to run so he wouldn't split the vote four ways.  He wasn't talking about Kathy or me.
